Terms of Use

1. Introduction
These Terms of Use govern your access to and use of RadioGift (the "Platform"), operated by RadioGift, a company registered in the European Union. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform. These Terms apply to all users, including event organizers, contributors, and visitors.
2. Service Description
RadioGift is a web-based platform that enables organizers to create personalised radio show events. Contributors (friends and family of the celebrated person) upload audio messages and dedicate songs via a shared link without needing an account. Professional DJs then produce the final radio show, which is delivered digitally to the organizer via download and/or streaming link.
3. Accounts and Registration
Organizers must create an account to use the Platform. You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account. Contributors do not need an account but must provide a name and email address for their submission.
4. Organizer Responsibilities
As an organizer, you are responsible for: ensuring you have the right to create an event for the named person; sharing the contribution link only with intended participants; setting appropriate deadlines; ensuring all content associated with your event complies with applicable laws; and informing contributors about how their data and audio recordings will be used in the radio show production.
5. Contributor Terms
By submitting a contribution, you grant RadioGift and the event organizer a non-exclusive, royalty-free license to use your audio recording for the purpose of producing the personalised radio show. You confirm that your recording does not contain unlawful, defamatory, or harmful content. You may request deletion of your contribution by contacting us at privacy@radiogift.eu, subject to production status.
6. Pricing and Payment
The service costs €149 (base price) for up to 10 contributors and a 60-minute radio show, with a 2-minute message limit per contributor. Each additional contributor beyond 10 is charged at €15, calculated when contributions close. The maximum number of contributors per event is 50; larger events require a custom arrangement. Payment is collected in two stages: the base price (€149) is charged upfront at event creation, and any overage charges are invoiced when contributions close. Prices are displayed inclusive of VAT where applicable. Payments are processed securely via Stripe. Prices may change, but confirmed orders are honoured at the price displayed at the time of purchase. All prices are in EUR unless otherwise stated.
7. Cancellation and Refunds
Organizers may cancel an event at any time before delivery. Refund policy: (a) If no contributions have been received, a full refund is issued minus Stripe processing fees (approximately 3% + €0.25 per transaction). (b) If contributions have been received but the show is not yet in production, a 70% refund is issued minus Stripe fees. (c) No refund is available once the show is in production or has been delivered. Refunds are processed via Stripe to the original payment method within 5–10 business days. In accordance with the EU Consumer Rights Directive, you acknowledge that digital service delivery begins upon event activation and contribution collection.
8. Content and Moderation
RadioGift reserves the right to review, moderate, and remove any content that violates these Terms, applicable law, or community standards. This includes content that is illegal, defamatory, hateful, sexually explicit, promotes violence, or infringes intellectual property rights. We may suspend or terminate access for users who repeatedly upload prohibited content. In compliance with the EU Digital Services Act, we provide transparent reporting of content moderation actions upon request.
9. Intellectual Property
The RadioGift platform, including its design, code, branding, and DJ-produced content structure, is owned by RadioGift. Audio recordings remain the intellectual property of their respective contributors. Song dedications are processed in accordance with applicable music licensing frameworks. The final radio show is licensed to the organizer for personal, non-commercial use only.
10. Limitation of Liability
To the maximum extent permitted by applicable EU law, RadioGift's total liability arising from or related to these Terms shall not exceed the amount paid by the organizer for the specific event in question. RadioGift is not liable for indirect, incidental, or consequential damages. This limitation does not affect mandatory consumer rights under EU law, including statutory warranty rights. RadioGift is not responsible for contributor content or third-party song availability.
11. Termination
RadioGift may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or misuse the Platform. You may delete your account at any time via your account settings. Upon termination, your data will be retained for 30 days for dispute resolution purposes, after which it will be permanently deleted in accordance with our Privacy Policy.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email to registered users at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you disagree with the changes, you may terminate your account before the effective date.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the European Union and the Member State in which RadioGift is registered. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that Member State. Nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
